We like to assume that most people have our best interests in mind, but even when they don’t, we’d like to at least be aware of their interests so that we can make an informed decision. Even when it appears that groups share a common interest, when you really break it down, other parties will likely put their needs first, and that’s something you’ll want to remember if you ever suffer a work injury and need to file a claim. Who can you trust and who should you be wary of throughout the course of your claim? We take a closer look at who you can trust during your injury claim in today’s blog.
Who To Trust During Your Injury Case
Let’s talk about some of the motives of the involved parties and explain why you should or you shouldn’t put faith in these actors.
Your Employer – The fact of the matter is that your employer will have different interests for the case. A claim will likely cause their costs to rise, so their insurance company will likely fight you on some aspects of your claim. You will undoubtedly have helpful and supportive coworkers wishing you the best, but remember that your employer and the company they hired to issue a workers’ compensation insurance policy will be interested in protecting their bottom line. Be incredibly wary of placing blind trust in your employer to assist or resolve certain aspects of your case.
The Insurance Company – Most people are inherently wary of insurance companies, and rightfully so. They didn’t become profit giants by greenlighting every claim that comes across their desk. Their goal is to minimize their liability and your payout, but at least most people are aware of this dichotomy. Be careful in your correspondence with the insurance company, and know that it’s wise to consult with a lawyer before speaking with the insurance company or providing a statement about your injuries.
Your Doctor – This one is a little trickier because we’ve worked with countless doctors who truly want the best for their patients and are an ally in helping them secure a claim award, but again you’ll want to be careful assuming that your doctor always has your best interests at heart. Your company may try to push you to a specific provider who has a history of downplaying injuries or providing a favorable independent medical report to the insurance company. Again, it’s wise to talk with a lawyer to see if they can recommend a good doctor, or you should do some research on your own and find a provider who you have faith in to conduct your medical examination. You should be able to trust your doctor, but don’t trust them all blindly, because some will inherently be better for your case and your health than others.
Your Lawyer – Your lawyer is one party who is truly on your side when it comes to an injury claim. That’s because lawyers get paid on a contingent basis, meaning they get a small percentage of the award they secure for their clients. This means that they take home a larger amount when they secure a bigger payday for their client. They have a vested interest in getting you the biggest award possible because it also means that they’ll take home a bit more. We’re not going to bill you for countless hours and leave you with a miniscule payday after pushing you to take a bad settlement. Our interests are aligned, and it’s nice to know that injury lawyers only exist if they can continually win for their clients, and that’s what we want to do for you. Not every lawyer is perfect, so it’s always smart to have your guard up at the outset, but when you find a good lawyer you can take solace in the fact that you can trust what they are doing for you and for your claim.
